Terms of Use

Preamble

The SMA Reporting Standard and the services provided through it (together referred to as the “Standard”) are owned and operated by SMA Standard Pty Ltd (ABN 97 684 360 745).

The following terms form the Terms of Use (Terms) for your use of the SMA Reporting Standard.  Please carefully read these Terms before using this Service. By submitting data to the SMA Reporting Standard, you agree to be bound by these Terms. If you do not accept these Terms, you must not continue to use the Service.

These Terms apply whenever you access the SMA Reporting Standard, regardless of how you interact with it, including but not limited to: desktop browsers, tablets, smartphones, or other connected devices.

We may change these Terms at any time, and any modifications will take effect upon posting to this webpage. Your continued use of the Service for the Standard following any changes indicates your acceptance of the changes.

Use of the Service is subject to our Privacy Policy

If you are registering an account or using the SMA Standard on behalf of an employer or business entity, you represent and warrant that you are authorised to act on behalf of the entity and bind them to these Terms.

Purpose and Scope

The Standard has been developed to provide a uniform structure and data consistency for Separately Managed Accounts (SMAs) in Australia. The SMA Reporting Standard is not a regulatory framework and does not constitute legal or financial advice. Its purpose is to enhance transparency, standardisation and industry recognition of SMAs by establishing a voluntary, industry-wide reporting protocol. 

SMA Managers are encouraged to take responsibility for reporting their SMAs under this Standard to ensure consistency across platforms

By using the SMA Standard, you acknowledge that we do not regulate or validate the compliance of any SMA with ASIC, financial services laws or prudential regulations

SMA Reporting Standard Services

The Standard operates in conjunction with the Monitor (the “Monitor”), a tool designed to facilitate the implementation and adherence to the Standard. Your use of the Monitor is subject to its own Terms of Use, which can be temporarily be found at https://www.productrex.com.au/mtou 

The SMA Reporting Standard provides a centralised framework for reporting data related to Separately Managed Accounts (SMAs).

The Services include providing a structured data format for SMA reporting, certifying data entries that comply with required fields, making certification records publicly available for third parties such as SMA managers, platforms and advisers, and distributing data to linked companies to enhance market insights.

There are limitations to this Service. We do not verify the accuracy or completeness of submitted data, only that it conforms to the required fields and other parameters enforced by the standard. We may provide guidance if submitted data appears inconsistent, but this guidance is not legally binding and should not be relied upon for compliance or decision making. The Service is strictly for SMAs and cannot be used for any other investment vehicles. Once submitted, data cannot be removed from the Service. Changes to the Standard are at our discretion, and we may modify it without prior notice.

Your access and use of the SMA Standard are conditional on compliance with these Terms and applicable laws. We reserve the right to suspend or terminate your access without notice if you breach these Terms or any legal requirements.

Fees

We do not currently charge any fees for certification or additional services under these Terms of Use. However, we reserve the right to introduce fees at our discretion in the future. Should any fees be introduced, we will provide advance notice of at least thirty days before they take effect.

Data Submission and Usage

By using the SMA Standard, you acknowledge and agree that you are solely responsible for ensuring the accuracy of the data you provide. Once submitted, data cannot be removed from the system.

You grant us and our affiliated entities the right to use, process, and share the submitted data in aggregated and anonymised form for market insights, reporting, analytics, and other business purposes. This use will not disclose any proprietary methodologies, strategies, or other intellectual property belonging to SMA managers.

We may also make certification records publicly available for third parties, such as investment platforms, to verify compliance with the SMA Standard.

Although we may provide guidance on submitted data, this guidance is not legally binding and should not be relied upon. We do not guarantee the accuracy, completeness, or reliability of any submitted data.

Failure to comply with these requirements may result in the suspension or termination of access to the Service.

Participant Levels

The SMA Reporting Standard provides different levels of access and participation:

Guest: May read and reference the Standard, but may not implement it, use certification badges, or claim compliance with the Standard.

Participant: May implement and certify compliance with the Standard, provided the certification status remains current. Participants are permitted to use SMA Reporting Standard badges in accordance with our branding guidelines.

Foundation Partner: This designation is granted at our discretion to recognise organisations that have demonstrated strong industry leadership and commitment to the Standard. Being a Foundation Partner does not confer any additional rights or benefits beyond public recognition. We reserve the right to revoke this designation at any time, without notice, if we determine it is no longer appropriate.

Intellectual Property

We own all intellectual property rights in relation to the SMA Standard, including any certification records, database structures, and related content. These Terms do not transfer any intellectual property rights from us to you or any third party.

By submitting data to the SMA Standard, you grant us a non-exclusive, royalty-free, perpetual, irrevocable license to use, distribute, and share the data for purposes related to the SMA Standard.

If you infringe on our intellectual property rights or those of any third party, we have the right to immediately suspend or terminate your access to the Service without notice. You agree to indemnify us against any claims brought by third parties related to your data submissions or use of the Service.

Privacy and Data Handling

Your use of the SMA Standard may involve submitting data that contains personal or proprietary information. You warrant that you have obtained all necessary consents and complied with applicable laws before submitting any such data.

We will handle submitted data in accordance with our Privacy Policy, but we make no guarantees about confidentiality. Once submitted, data cannot be removed, and it may be publicly accessible as part of the certification record.

By using the Service, you consent to the collection, processing, and use of submitted data for certification and distribution purposes.

Use of the SMA Standard

You must use the SMA Standard only for the purpose of maintaining and ensuring the accuracy of data related to SMAs.

You must not attempt to modify, copy, or reverse-engineer the SMA Standard. You may not use the Service to submit false, misleading, or fraudulent information. You must not introduce any harmful code or attempt to disrupt the integrity of the Service.

We may suspend or terminate your access at any time if you fail to comply with these restrictions.

Disclaimers and Limitations of Liability

You acknowledge that the use of the SMA Standard is at your own risk. We provide the Service “as is” without warranties of any kind.

We do not verify the accuracy of submitted data and do not assume any responsibility for errors, omissions, or inaccuracies. We are not liable for any direct, indirect, or consequential damages resulting from your use of the Service.

To the extent permitted by law, our liability is limited to the resupply of the Service or the amount paid for the Service in the past twelve months, whichever is lower.

Indemnity

You agree to indemnify and hold us harmless against any claims, losses, or damages arising from your use of the SMA Standard, including any data submissions that result in disputes, legal actions, or third-party claims.

You also agree to indemnify us against any regulatory actions resulting from your use of the Service or reliance on certification records.

Termination and Modification

We reserve the right to modify, suspend, or terminate the SMA Standard at any time without prior notice.

If you wish to terminate your use of the Service, you must notify us in writing. However, any submitted data will remain part of the certification record and will not be removed.

We may update these Terms at any time, and your continued use of the Service constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising from these Terms.
